ONLINE SERVICE AGREEMENT – TERMS & CONDITIONS

1. ACCEPTANCE OF SERVICE AGREEMENT

By completing and submitting an online order through Edmonton Process Servers, the customer acknowledges and agrees to all terms and conditions contained in this Service Agreement.

This agreement becomes effective when the customer submits their online order and payment is successfully processed.

By proceeding with an online order, the customer authorizes Edmonton Process Servers to undertake the services purchased.

2. SERVICES PROVIDED

Edmonton Process Servers provides professional legal document delivery, process serving, court filing services, and related services.

Our services may include:

  • Serving legal documents on individuals and businesses.

  • Serving civil claims, family court documents, notices, and other legal materials.

  • Eviction-related document serving.

  • Preparing Affidavits of Service or Attempted Service.

  • Court document filing when purchased.

  • Rush process serving when purchased.

  • Providing electronic service documentation and updates.

All services are performed in accordance with applicable laws and court procedures.

3. SERVICE ATTEMPTS AND TIMEFRAMES

A service attempt is an actual attendance at the supplied service location for the purpose of serving documents.

Each authorized visit counts as one attempt, whether the intended recipient is present or available.

Service attempts may be conducted at reasonable times based on the information provided and applicable legal requirements.

The customer understands that:

  • Successful service cannot be guaranteed.

  • Service depends on locating the intended recipient.

  • The recipient may be unavailable, refuse documents, or avoid service.

  • Purchased attempts are included regardless of whether service is successful.

  • Any additional attempts beyond the purchased package require authorization and additional payment.

Service timeframes are targets, not guarantees, unless expressly agreed otherwise in writing.

4. CUSTOMER RESPONSIBILITIES

The customer agrees to provide accurate and complete information, including:

  • Full name of the person or business being served.

  • Correct service address.

  • Any relevant identifying details.

  • Complete and legible legal documents.

  • Court dates, deadlines, and special instructions.

  • Any known safety concerns involving the intended recipient.

The customer is responsible for ensuring that the documents supplied are complete, accurate, and suitable for the intended legal proceedings.

Edmonton Process Servers is not responsible for delays, unsuccessful attempts, or additional costs resulting from incorrect addresses, incomplete documents, inaccurate information, or omitted instructions.

5. NO GUARANTEE OF SUCCESSFUL SERVICE

Edmonton Process Servers agrees to make reasonable professional efforts to complete the purchased services.

However, payment is for the professional service attempts, administrative work, and related services provided, not a guarantee that the intended recipient will be successfully served.

Unsuccessful service does not automatically entitle the customer to a refund.

If service cannot be completed, the customer will receive an appropriate report or Affidavit of Attempted Service, where applicable.

6. CANCELLATION AND REFUND POLICY

Once work commences on an order, no refund will be provided for services performed or costs properly incurred, except where required by applicable law.

Work may include reviewing documents, processing the order, preparing service instructions, assigning a process server, travelling to the service location, attempting service, or completing related administrative duties.

Cancellation requests received before work commences will be reviewed, and any refund will be determined in accordance with applicable consumer protection laws.

Once service attempts have commenced, unsuccessful service, an unavailable recipient, an incorrect address supplied by the customer, or a customer's decision not to proceed does not automatically entitle the customer to a refund.

Nothing in this agreement removes or limits cancellation or refund rights provided by applicable legislation.

7. COURT DEADLINES AND LEGAL RESPONSIBILITY

The customer is responsible for notifying Edmonton Process Servers of all court dates, filing deadlines, and service deadlines.

Edmonton Process Servers does not provide legal advice or legal representation.

The customer remains responsible for obtaining independent legal advice when required.

We do not guarantee that service will be completed by a court-imposed deadline unless expressly confirmed in writing.

8. AFFIDAVITS AND SERVICE DOCUMENTATION

Where included in the purchased service, Edmonton Process Servers will provide the applicable Affidavit of Service or Attempted Service, or other relevant service documentation.

Any affidavit will reflect the actual actions and observations of the individual performing the service.

Edmonton Process Servers will not provide inaccurate, misleading, or false affidavits.

Acceptance of documents by a court, or a court's determination that service was legally valid, remains subject to applicable legal requirements.

9. PAYMENTS AND CREDIT CARD TRANSACTIONS

All prices are in Canadian dollars and are subject to applicable GST.

Payment is required before services commence unless otherwise agreed in writing.

All credit card payments will appear on the customer's credit card statement under the name LCM Services.

By completing an online purchase, the customer authorizes the applicable payment to be processed for the selected services.

Edmonton Process Servers remains responsible for obligations and liabilities that cannot legally be excluded.
